Ruling of the Constitutional Court on the application lodged by the Acting Prosecutor General for review of the constitutionality of certain legal provisions

Today, on 8 August 2023, the Constitutional Court of the Republic of Moldova delivered its judgment on the application of the Acting Prosecutor General No. 18a/2022 on the constitutionality review of certain provisions of Law No. 270 of 23 November 2018 on the unitary salary system in the budgetary sector and Law No. 271 of 23 November 2018 on amending certain legislative acts.

Inter alia, the High Court ruled: ‘Article 12 para. (15), 29 par. (2) and Annex No. 4 Table 1 in the part relating to prosecutors of Law No. 270 of 23.11.2018 on the unitary system of salaries in the budgetary sector, insofar as the annual adjustment of the size of the reference salary amount for prosecutors is mandatory and is based at least on the average annual inflation rate on the date of adoption of the State Budget Law for the following year”.

In this context, the authorities will be obliged to adjust prosecutors’ salaries at least in line with the inflation rate – a position similar to that adopted by the Constitutional Court with regard to judges’ salaries.

In this context, the General Prosecutor’s Office underlines the major importance of the Constitutional Court’s solution for strengthening the independence of the judiciary in general and of prosecutors in particular.

The judgment of the High Court is final, is not subject to appeal and enters into force on the date of its adoption.
