The regulation regarding the Advisory Council to the Government Agent has been amended

October 27, 2023, Chisinau – The Cabinet of Ministers approved today the amendments to the Regulation regarding the Advisory Council under the Government Agent, which proposes to update the composition of the Advisory Council and improve some provisions regarding its functionality.

“It is worth noting that, from the moment the Regulation was approved until now, this Advisory Council has not been established. Thus, as a result of the reconceptualization of the functions of state officials in the government structure, there was a need to change the composition, namely to replace the functions of deputy ministers of justice, finance and internal affairs with the functions of state secretaries of the same governmental entities”, he explained Minister of Justice, Veronica Mihailov-Moraru.

According to the Regulation in force, the Council consists of representatives of public authorities, the academic environment and civil society. Through this draft decision, it is proposed to include, as members of the Council, one representative each from the Supreme Court of Justice, the General Prosecutor’s Office and the Office of the People’s Advocate, who will contribute to the efficiency of the mechanism for the protection of human rights and freedoms.

Another important change refers to a distinct approach to the situations in which the Council examines subjects related to the representation of the state before the European Court of Human Rights (ECtHR) from those regarding the execution of judgments and decisions of the ECtHR.

The amendments to the Regulation will enter into force with the publication in the Official Gazette, in order to allow the establishment of the Advisory Council as quickly as possible.

According to the Law on the Governmental Agent, the Advisory Council works alongside the Governmental Agent and has the role of ensuring the good representation of the Republic of Moldova before the ECtHR and executing ECtHR rulings and decisions.
