Sentenced to 6 months in prison for failing to comply with domestic violence victim protection order
According to the sentence of the Court of Balti, Falesti, dated August 14, 2023, a 34-year-old man was found guilty of not executing the measures of the order of protection of the victim of domestic violence, and was sentenced to a prison term of 6 months, with execution of the sentence in a semi-closed prison.
This is not the defendant’s first criminal offence.
During the criminal prosecution, prosecutors charged the defendant in December 2022 with violating the protection order issued on December 14, 2022, in which he was recognized as a domestic abuser and a series of restrictions were placed on him, including the obligation to stay away from his mother’s place of residence and to communicate with her for a period of three months, ignoring these measures ordered by the court, under various pretexts, at a time when the victim was at home, he entered her home and contacted her.
The defendant fully admitted his guilt for the act of which he was accused. The sentence is subject to appeal to the Balti Court of Appeal within 15 days.
Note: A person accused of committing a crime is presumed innocent until proven guilty by a final court decision.
We remind you that, according to Article 320/1 of the Criminal Code, wilful failure or evasion of the execution of the measures established by the court in the order of protection of the victim of domestic violence (e.g. temporary leaving the home, prohibition to contact the victim, including by telephone, prohibition to approach the victim, etc.) is punishable by unpaid community service from 160 to 200 hours or imprisonment for up to 4 years.
