Suspended prison sentence for the citizen of the Republic of Moldova who, together with a citizen of Ukraine, bribed a border policeman

On July 25, 2023, the Edineț Court, the Central Headquarters pronounced the sentence in the criminal case referred to the justice by the Anticorruption Prosecutor’s Office North, which concerns the actions of a citizen of the Republic of Moldova, accused of active corruption (art. 325 para. (2) letter b ) from the Criminal Code).

The respective criminal case was disjointed by the Northern Office of the Anti-Corruption Prosecutor’s Office from the basic criminal case in February 2023, for the identification and criminal prosecution of the accomplices of the citizen of Ukraine, who was referred to justice and sentenced on April 19 this year to actual prison sentence for a term of 3 years. The criminal prosecution of the case was carried out by the General Territorial Directorate “North” of the NAC.

According to the materials, the citizen of the Republic of Moldova, together with the citizen of Ukraine, promised and sent to an employee of the Border Police, 500 US dollars to allow the removal of a minor without any identity document from the Republic of Moldova.

The criminal prosecution and trial of the case in this criminal case lasted 5 months, the defendant admitted her guilt of committing the criminal act and, at her request, the criminal case was examined based on the evidence administered during the criminal investigation phase, without requesting the administration of new evidence.

By sentence of July 25, 2023, the court found the defendant guilty of committing active corruption, sentencing her to prison for a term of 3 years, with the suspension of prison execution for a probationary period of 5 years and a fine of 200,000 lei.

The preventive measure in the form of pre-trial detention applied to her was replaced by the obligation not to leave the country until the finalization of the sentence.

The sentence will be challenged with an appeal to the Balti Court of Appeal on the grounds of the mildness of the criminal penalty applied.

Note: A person accused of committing a crime is presumed innocent until proven guilty by a final court decision.
