The interim Prosecutor General’s complaints against four judges fully admitted by the SCM

On 14 November 2023, the Plenum of the Superior Council of Magistracy admitted the four requests of the interim Prosecutor General, Ion Munteanu, for the release of the consent to prosecute judges.

In the first case, one of the judges is suspected of influence peddling and passive bribery (Article 324(3)(a), Article 326(1), Article 326(11), Article 326(2)(b) of the Criminal Code). The Council therefore gave its consent to the initiation of prosecution actions, including arrest, detention, arrest and search.

For two other judges, who are suspected of complicity in influence peddling (Art. 42 (5), Art. 326 (11), Art. 326 (2) (b) of the Criminal Code) and influence peddling (Art. 326 (2) (b) of the Criminal Code) respectively, consent was given for the same prosecution actions.

The last judge involved is suspected of active bribery (Article 325(3)(a1) of the Criminal Code), and consent has been issued for his prosecution, arrest, detention, arrest and search.

Criminal prosecution is carried out by the Anticorruption Prosecutor’s Office with the support of the National Anticorruption Centre. The Anti-Corruption Prosecutor’s Office will provide further details of the case in due course, respecting the rights of the participants in the criminal proceedings.

The Prosecutor’s Office reiterates its commitment to fighting corruption and ensuring the integrity of the judicial system and will take all necessary actions to eradicate this phenomenon.
